Monroe County Court and Greece Felony Cases

Monroe County Court prosecutes all felony cases from Greece. The Monroe County Clerk's Office maintains the official court records. Under FOIL (Public Officers Law §§ 84-90), the department has five business days to respond. They can provide the records, deny in writing, or give you a date when the records will be ready. Your Own Criminal History

To get your own criminal record, use the DCJS Record Review process. This is not done through FOIL. You submit fingerprints and DCJS sends you your personal criminal history. Call 518-457-9847 or email RecordReview@dcjs.ny.gov. The unsuppressed version shows everything, including sealed records. The suppressed version leaves out sealed items.

You cannot use FOIL to request criminal history records for another person from DCJS. That restriction is firm. FOIL works for specific documents held by a specific agency, like a police report or a court filing. But the full rap sheet maintained by DCJS is only available to the person it belongs to, through the Record Review process.

Felony Record Sealing in Greece

CPL § 160.50 seals records from arrests that did not end in a conviction. Dismissals and acquittals fall under this rule. The sealing should be automatic, but check to make sure it went through if you have concerns about an old case.

CPL § 160.59 lets people apply to seal up to two convictions. No more than one can be a felony. You must wait ten years after finishing the sentence. Violent felonies and sex crimes are excluded. The judge decides based on the facts of the case and the person's record since the conviction.

The Clean Slate Act took effect November 16, 2024. Over the next three years, the state courts will build a system for automatic sealing of eligible older convictions. Sex crimes and non-drug Class A felonies like murder will not be sealed. Law enforcement keeps access to all records. For Greece residents with old felony records, this law may change what appears in a public search.
