Sealed Felony Records in Troy
CPL § 160.50 provides for automatic sealing of records when an arrest does not result in a conviction. Dismissals, acquittals, and adjourned-in-contemplation cases that are later dismissed all qualify. These records are removed from public view. Law enforcement and courts still have access.
CPL § 160.59 allows a person to apply for sealing of up to two criminal convictions, with no more than one felony. A ten-year waiting period runs from the end of the sentence. Violent felonies, sex crimes, and Class A felonies are excluded. The court considers the nature of the crime, the time elapsed, and the applicant's rehabilitation.
The Clean Slate Act took effect November 16, 2024. This law provides for automatic sealing of eligible conviction records over time. The Office of Court Administration has up to three years to fully implement the process. Sex crimes and non-drug Class A felonies are not eligible for automatic sealing. Police, prosecutors, and courts retain full access to all records.
