Greenburgh Felony Records Lookup
Greenburgh felony records are processed through the Westchester County court system in the lower Hudson Valley. This large town sits in the 9th Judicial District and includes several villages within its borders. All felony cases from Greenburgh go to Westchester County Court for prosecution. Local violations and misdemeanors stay in the town justice court, but anything above that level moves to the county. Here is what you need to know about finding and requesting these records.
Greenburgh Overview
Westchester County Court and Greenburgh Felony Records
Westchester County Court handles felony prosecutions from Greenburgh. The 9th Judicial District administration is at 111 Dr. Martin Luther King Jr. Blvd., 11th Floor, White Plains, NY 10601. Phone: 914-824-5100. The District Administrative Judge is Hon. Anne E. Minihan.
The Greenburgh Police Department serves the unincorporated parts of the town. They make arrests, investigate crimes, and file reports. When a felony arrest happens, the case starts in Greenburgh Justice Court for arraignment. The judge sets bail and holds a preliminary hearing. If a grand jury returns an indictment, the case transfers to Westchester County Court.
The Westchester County Clerk maintains official court records for felony cases. You can search some of those records through their public records portal. The clerk holds indictments, plea records, sentencing documents, and other court filings. For criminal-specific records, the Westchester criminal records page may have additional search options.
How to Request Greenburgh Felony Records
FOIL is the law that governs public records access in New York. It is found in Article 6, Sections 84 through 90, of the Public Officers Law. Every town and county agency must follow these rules.
For records held by the Greenburgh Police Department, submit a written FOIL request to the town. The Town Clerk handles administrative records, while police records go through the department's records officer. Include the person's name, date of arrest or incident, and any case numbers. Be as specific as you can. Vague requests take longer to process and may be denied.
The agency has five business days to do one of three things: give you the records, deny the request in writing, or send an acknowledgment with an estimated completion date. Most responses come within twenty business days. Copies cost $0.25 per page for standard sizes. If you want to inspect records in person, you can do that and take photos with your own device instead of paying for copies.
If your request is denied, appeal in writing to the Town Attorney within 30 days. The appeal must be decided within ten business days. If the appeal is also denied, you can file an Article 78 proceeding in court.
State Databases for Greenburgh Felony Records
The Criminal History Record Search from the Office of Court Administration costs $95 and returns conviction data from courts across New York. This is the broadest tool for checking felony convictions.
The DOCCS Inmate Lookup is free. It lists people in state prison or on parole. Search by name or DIN number. The Sex Offender Registry run by DCJS shows registered offenders by name, zip code, or county.
For your own criminal history, the DCJS Record Review is the right path. You must submit fingerprints. Call 518-457-9847 for details. This process is separate from FOIL and gives you your complete personal rap sheet, including sealed and suppressed records on an unsuppressed version.
Sealed Felony Records in Greenburgh
CPL § 160.50 requires that arrests not resulting in convictions be sealed. Dismissals, acquittals, and cases terminated in favor of the accused all fall under this rule. The sealing is supposed to be automatic, but you may need to verify it happened.
Under CPL § 160.59, a person can petition to seal up to two convictions if no more than one is a felony. The wait is ten years from the end of the sentence. Violent felonies and sex crimes cannot be sealed this way. The judge looks at the nature of the crime, the person's record since, and the impact on the community.
The Clean Slate Act took effect November 16, 2024. Over the next three years, the Office of Court Administration will develop a process for automatic sealing of eligible old convictions. Sex crimes and non-drug Class A felonies are excluded. Police and courts retain full access to sealed records. For Greenburgh residents, this may reduce what shows up in public searches going forward.
