Records include both felony and misdemeanor case files. These are classified as public records under New York Public Officers Law Section 86, with certain restrictions on what can be disclosed. DCJS maintains fingerprint-based criminal history records that are not public. The DCJS Record Review costs $63.50 and lets you check your own record. You must submit fingerprints. These records cannot be requested for another person.

Sealed Records and Westchester County Felony Cases
Several New York laws control when criminal records get sealed. CPL Section 160.50 seals records automatically when charges are dismissed or a person is acquitted. CPL Section 160.59 allows people to petition for sealing of eligible convictions after 10 years. The person cannot have more than two misdemeanor convictions or one felony and one misdemeanor conviction. No pending charges can be open when the petition is filed. The DA has 45 days to object.
The Clean Slate Act took effect November 16, 2024. Under it, OCA has up to three years to set up automatic sealing. Misdemeanor convictions will seal 3 years after the sentence is done. Felonies seal after 8 years. Sex crimes and non-drug Class A felonies like murder are excluded from sealing. Until the system is fully running, records that will eventually be sealed still show up in search results. This affects both county-level and statewide searches.
CPL Section 160.58 allows sealing of certain drug convictions after treatment program completion. CPL Section 720.35 protects youthful offender records. Correction Law Section 9 directs DOCCS to remove public information 3 years after a person finishes their sentence. Sealed records remain accessible to law enforcement, prosecutors, courts, and certain licensing boards authorized by law.
