Suffolk County Court and Southampton Felony Cases

There are some rules to keep in mind. You must list the specific records you want. Do not use vague language like "any and all information." That does not count as a reasonable description and your request may be denied. Include the full street address for property-related records, the calendar year for tax or assessor records, and the specific board name and meeting date for minutes or resolutions.

Fire incident reports go through the Office of Fire Prevention, not through FOIL. Town Trustees operate as an independent body with a separate FOIL process. Many records are already posted on department websites. The town encourages people to check online first before filing a formal request.

Sealed Felony Records in Southampton

CPL § 160.50 seals arrest records that did not lead to a conviction. Dismissals, acquittals, and cases terminated in the accused's favor are covered. This is an automatic process under New York law. These records do not show up in public searches.

CPL § 160.59 lets people petition to seal up to two criminal convictions, with no more than one felony. The waiting period is ten years from the end of the sentence, including parole or probation. Violent felonies and sex crimes are excluded. The petition goes to the court where the conviction happened. The judge reviews the request and considers the nature of the crime, the time that has passed, and the person's record since.

The Clean Slate Act, effective November 16, 2024, provides for automatic sealing of eligible old convictions. The Office of Court Administration has up to three years to develop the process. Murder and sex offenses are excluded. Police and courts retain full access to all sealed records. This new law may reduce what shows up in public background searches for Southampton residents with old felony records.

Appeals for FOIL Denials

If your FOIL request is denied, you have 30 days to appeal. The appeal goes in writing to: James M. Burke, Esq., Town of Southampton Attorney, 116 Hampton Road, Southampton, NY 11968. The appeal must be decided within ten business days. If the appeal is denied, you can file an Article 78 proceeding in court. The court may award attorney's fees if you substantially prevail.

Law enforcement records have specific exemptions under Public Officers Law § 87(2)(e). Records compiled for law enforcement can be withheld if releasing them would interfere with an investigation, deny someone a fair trial, reveal confidential sources, or expose non-routine investigative techniques.
