Queens District Attorney and Prosecution Files

The Queens County District Attorney's Office at 125-01 Queens Boulevard in Kew Gardens prosecutes all felony cases in the county. The office handles everything from drug charges to violent crimes and white-collar fraud. Prosecution files are not public records in the same way court files are. Access to DA records is more limited, and FOIL requests for these files are often partially denied if the information could harm an active case.

Under CPL Section 160.59, a person with eligible convictions can petition the court to seal their records. The DA's office gets 45 days after being served to file an objection. If they do not object, the court may grant the sealing order. Queens County sees a high number of sealing petitions because of its large population and the volume of cases processed each year. The DA also participates in grand jury proceedings that produce the indictments for felony cases in the county.

NYPD Records and Arrest Data in Queens

The New York City Police Department handles all law enforcement in Queens County. NYPD precincts in Queens generate arrest reports, incident reports, and complaint records for felony cases. NYPD arrest records for adults are generally public under Public Officers Law Sections 84 through 90. Some information can be withheld if it would compromise an investigation or reveal the identity of a confidential informant. Under CPL Section 160.50, if a case ends in the defendant's favor, the NYPD must seal the arrest record. That means the mugshot, fingerprints, and booking data go back to the person or get destroyed. Response times for NYPD FOIL requests can run several weeks because of the volume of requests the department handles.

Until the Office of Court Administration finishes setting up the sealing system by November 2027, some records that will eventually be sealed may still appear in search results. Correction Law Section 9 also limits how long DOCCS can post inmate data online after a sentence ends.
