Nassau County Clerk's Office

Only felony convictions are filed here. Misdemeanors go to the local court where the case was heard, whether that's a district court, city court, or village court. The County Clerk does not hold those records. This is a point that confuses many people, so it is worth keeping in mind.

Records are indexed by number and year. If you have the index number, the search is quick. Without it, staff can search, but the fee is $5 for each two-year span. Copies cost 65 cents per page, with a $1.30 floor. Certified copies are $5 for up to four pages, then $1.25 per page after that. Payment by cash, check, Visa, or MasterCard. Mail requests are accepted with a check payable to Nassau County Clerk.

Nassau County Court and Felony Cases

Nassau County Court is at 262 Old Country Road, Mineola. Phone: (516) 493-4100. It has jurisdiction over all felony criminal cases in the county. Nassau is part of the 10th Judicial District, which it shares with Suffolk County.

This is a high-volume court. The suburban population drives a large caseload. The Grand Jury meets often to evaluate felony indictments. Court sessions run year-round for both criminal and civil matters. Treatment courts handle substance abuse cases and other specialized needs. Appeals from City, Town, and Village Courts are also heard here. All proceedings are open to the public unless ordered sealed by a judge.

District Attorney's Office

The Nassau County District Attorney is at 262 Old Country Road, Mineola. Call (516) 572-2200. The office prosecutes all felonies and some misdemeanors. It is organized into specialized bureaus: Major Offenses, Special Victims, and Economic Crimes, among others.

Every arrest gets reviewed for proper charges. Felony cases are presented to the Grand Jury. Discovery is shared with defense counsel under CPL Article 240. The office runs victim services and witness assistance. Diversion programs are available in some cases. Community outreach and crime prevention are part of the office's work as well.

Nassau County Police Department

The Nassau County Police Department is the main law enforcement agency for the county. Headquarters is at 1490 Franklin Avenue, Mineola, NY 11501. Call (516) 573-7000. Some villages have their own police departments, but NCPD covers most of the county.

The Records Division keeps incident reports, arrest records, and accident reports. FOIL requests are the standard way to get these records. Under Public Officers Law sections 84 through 90, most law enforcement records are public, with exceptions for active investigations and certain sensitive material. The department runs multiple precincts and specialized units across the county. Fingerprinting services are available for various purposes.

Statewide Databases for Nassau County Felony Records

The OCA Criminal History Record Search costs $95 per name search. It pulls results from all 62 counties and shows open cases and convictions. Sealed records are excluded. Results come back the next business day for online submissions. Each alias or different date of birth counts as a separate search at full price.

WebCrims is free and covers Nassau County Court along with NYC and other suburban courts. It shows pending cases with future court dates. Once a case is finished, it drops off. The DOCCS Incarcerated Lookup is free too and shows state prison inmates. The Sex Offender Registry lists Level 2 and Level 3 offenders online.

Sealed and Restricted Felony Records

CPL section 160.50 seals cases that end in dismissal or acquittal. CPL section 160.59 allows petitioning a judge to seal up to two older convictions. Sex offenses and Class A felonies cannot be sealed under this provision. CPL section 160.58 covers drug convictions after completing treatment. The Clean Slate Act, taking effect in late 2024, will automate sealing for eligible records over a three-year period.

Sealed records are still visible to law enforcement, prosecutors, and courts. They are not disclosed on public record searches like the OCA CHRS or WebCrims. The DCJS Record Review process shows sealed records on unsuppressed reports, but those are only available to the person themselves (or their attorney) for $62 through a fingerprint-based request.

How to Get Records Through FOIL

New York's Freedom of Information Law covers all government agencies in Nassau County. Submit a written request to the records access officer at whichever agency has the records you need. Be specific: give names, dates, case numbers, and the type of record. The agency must acknowledge your request within five business days. Records are typically provided within 20 business days. Copy fees are capped at 25 cents per page for standard copies. Electronic copies by email are often free.
