Oneida County Clerk's Office

The County Clerk in Utica serves as Clerk of Supreme and County Courts. All felony case files from these courts are filed and stored here. Only felony convictions reach this office. Misdemeanor records stay with the local court of origin, whether that is Utica City Court, Rome City Court, or a town or village court.

Copies cost 65 cents per page with a $1.30 minimum. Certified copies are $5 for up to four pages, then $1.25 per extra page. If you don't have the index number, the search fee is $5 for each two-year block. The office accepts cash, checks, Visa, and MasterCard. Felony Court System in Oneida County

Oneida County Court has jurisdiction over all felony cases in the county. It shares the 5th Judicial District with six other counties. The Grand Jury meets to review evidence and decide on indictments. If a true bill is returned, the case goes to trial in County Court.

The court runs regular sessions for criminal and civil matters. Treatment courts may be available for cases involving substance abuse. Appeals from City, Town, and Village Courts within Oneida County are also heard here. All proceedings are public unless sealed by court order. Records of proceedings are available during business hours at the Clerk's Office.

Utica City Court handles initial arraignments for arrests made in the city. It also has jurisdiction over misdemeanors and violations. Preliminary hearings for felonies are held there before cases move to County Court. Rome City Court serves the same function for the City of Rome.

District Attorney and Law Enforcement

The Oneida County District Attorney reviews all arrests and decides what charges to file. Felony cases are presented to the Grand Jury for indictment. Discovery materials go to defense counsel under CPL Article 240. The office provides victim services and may offer diversion programs for certain cases.

The Oneida County Sheriff's Office provides law enforcement for towns and villages that don't have their own police. It operates the county jail and maintains arrest records, incident reports, and booking data. FOIL requests are the way to access these records. Under Public Officers Law sections 84 through 90, most records are public with some law enforcement exceptions. The Utica Police Department handles law enforcement within city limits and keeps its own set of records.

The OCA Criminal History Record Search costs $95 per search. It covers all 62 counties and returns conviction and open case data. Sealed records won't show. Town and village court data may be incomplete for older cases. Results come back the next business day online.

The DOCCS Incarcerated Lookup is free. It shows current and former state prison inmates going back to the early 1970s. Violent felons and sex offenders remain listed. Non-violent offenders may be removed three years after finishing their full sentence under Correction Law section 9.

WebCrims shows pending cases with future court dates for free. The Sex Offender Registry lists Level 2 and Level 3 offenders online. For a personal rap sheet, the DCJS Record Review costs $62 and needs fingerprints.

Record Sealing Laws

CPL section 160.50 seals cases that end in dismissal or acquittal. This happens automatically. CPL section 160.59 lets a person ask a judge to seal up to two prior convictions. Sex offenses and Class A felonies don't qualify. CPL section 160.58 covers drug convictions after completing a treatment program.

The Clean Slate Act will add automatic sealing for eligible records. The rollout started in late 2024 and will take up to three years. Records of sex crimes and non-drug Class A felonies are not covered. Law enforcement and courts keep access to all records, sealed or not. Youthful offender adjudications under CPL section 720.35 are already confidential.

Making a FOIL Request

The Freedom of Information Law gives you the right to request records from any government agency in Oneida County. Put your request in writing and send it to the agency's records access officer. Be as specific as you can. The agency has five business days to acknowledge receipt. Standard copy fees are 25 cents per page. Electronic copies are often free. If your request is denied, appeal to the FOIL Appeals Officer within 30 days.
